ComCo argues that Swisscom is changing the network architecture in its new deployments, so that alternative operators are unable to access the network.
A possible abuse of dominance: On 17 December 2020, the Swiss Competition Commission (ComCo) opened an investigation into the state-owned operator Swisscom. ComCo is concerned that Swisscom may be abusing its dominant position and forcing competitors out of the market in developing its FTTH network.
Why is the ComCo concerned? Swisscom plans to expand its FTTH network to an additional 1.5m households and businesses. In the areas where it is building alone, Swisscom is adopting a point-to-multipoint architecture, which would make competitors unable to directly access the infrastructure. ComCo believes Swisscom’s behaviour is likely to limit opportunities for its competitors, and to reduce choice for consumers.
Swisscom defends itself: ComCo issued an interim measure requiring Swisscom to continue to grant access to its network infrastructure, and launched an investigation which could last several months. In a statement, Swisscom responded that its network expansion plan is more cost-efficient and still enables competition. Wholesale customers will still be able to purchase upstream wholesale products.
